Not only wife and children, parents also shareholders in son’s income: Court

Delhi March 7 :Delhi’s Tis Hazare Court has ruled that not only a wife or children but a person’s elderly parents also have rights in his income.

While hearing the plea of a woman, Tis Hazari-based Principal District and Sessions Judge Girish Kathpalia, asked her husband to submit an income affidavit in the court. The woman who had filed the case seeking an increase in monthly allowance said that her husband was earning over Rs 50,000 per month but she and her two-and-half-year-old son were being given mere Rs 10,000 as monthly maintenance. To this, her husband had contented that he was earning Rs 37,000 per month and in this amount, he also had to take care of his elderly parents.

Court summons security officer in the case 
The court had summoned the security officer to file an affidavit on the defendant’s behalf. In his report, the security officer said that defendant had presented correct facts in the court and that as per his income tax statement, his monthly income is only Rs 37,000. In addition to this, the report also stated that besides the daily living expenses, the defendant has to bear the expenses of his parents’ illness. The court took this fact seriously but also added that he also has a responsibility towards his wife and child. So, the monthly allowance should be increased.

Court divides husband’s salary into 6 parts
While quoting an example of a family cake, the judge said that the monthly salary of an earning person is just like a family cake which needs to be distributed equally among the family members. The judge divided the defendant’s salary into 6 parts- giving two parts to him, on the part each to wife, son, father, and mother. While disposing of the case, the court directed the defendant to give 12.5 thousand to his wife on the 10th of every month.
